End-To-End Trade Digitalisation: Comparative Regulatory Analysis
The International and Comparative Law Research Center (ICLRC) conducted a comparative analysis in the context of the work of the UNCITRAL secretariat to study the implementation by States of the acts of the Commission (A/79/17, para. 299).
On the basis of questionnaire data completed for 13 jurisdictions (including EAEU countries and the European Union regulation), a review was prepared with the "heat map" showing the correlation of the approaches of the United Nations Convention on the Use of Electronic Communications in International Contracts and the UNCITRAL Model Laws with national approaches to the regulation of the principles of electronic commerce, electronic signatures, electronic transferable records, identification and trust services, and automated contracting.
The study aims to assess the effectiveness of the implementation of the Model Laws and to identify alternative approaches to regulating electronic commerce in the respective jurisdictions. Particular attention is paid to the principles of technological neutrality, functional equivalence, and non-discrimination.
