Advisory Opinions of the ICJ and the IACtHR on Climate Obligations of States (in Russian)

The year 2025 was one of the most prominent in the history of international climate change law: the International Court of Justice and the Inter-American Court of Human Rights issued their respective advisory opinions on state obligations in the context of climate change, thereby continuing the trend towards a greater role of courts in climate policy. Both opinions shed light on the current state of the climate component of international law in general, as well as of international human rights law in particular. This overview seeks to present key conclusions of both opinions, compare them with pronouncements made earlier on similar issues by the European Court of Human Rights and the International Tribunal for the Law of the Sea, as well as indicate the contours of their possible influence on the climate policy of individual countries and the broader world.
