On 27 May 2025, the International and Comparative Law Research Center organised a presentation of an article by the participants of the Investment Law and Arbitration Lab "Changes in the Regulation of Counterclaims and Denial of Benefits in Investment Disputes: In Search of a Balance Between the Interests of the Parties" (in Russian).
The article analyses the draft documents of the UN Commission on International Trade Law (UNCITRAL) Working Group III on the development of provisions on counterclaims and denial of benefits as part of the reform of the investor-State dispute settlement system. One of the challenges facing Working Group III is the lack of balance between investor rights and State rights. Over the course of several months, a group of Lab participants consisting of Nataliia Arzhaeva, Ilya Ulyanov, and Polina Yataeva studied the proposed language on counterclaims and denial of benefits and analysed the current practice. As a result, possible improvements were suggested and presented during the event.
