Presentation of the research of the participants of the Investment Law and Arbitration Lab

On 27 May 2025, from 16:00 to 18:00 (UTC+3), the International and Comparative Law Research Center will organise a presentation of an article by the participants of the Investment Law and Arbitration Lab "Changes in the Regulation of Counterclaims and Denial of Benefits in Investment Disputes: In Search of a Balance Between the Interests of the Parties (in Russian)". The event will be held in a hybrid format – in person in the ICLRC library (14, bldg. 3 Kadashevskaya Embankment) and online.

The article analyses the draft documents of the UN Commission on International Trade Law (UNCITRAL) Working Group III on the development of provisions on counterclaims and denial of benefits as part of the reform of the investor-State dispute settlement system. One of the challenges facing Working Group III is the lack of balance between investor rights and State rights. Over the course of several months, a group of Lab participants consisting of Nataliia Arzhaeva, Ilya Ulyanov, and Polina Yataeva studied the proposed language on counterclaims and denial of benefits and analysed the current practice. As a result, possible improvements were suggested and will be presented during the event.
